On July 22nd, 2008, a federal judge has scheduled a hearing on whether the Seneca Indian Tribe should be compelled to close down the casino operations of their Buffalo Casino establishment in the state of New York.
District Judge William Skretny will hear arguments regarding the case on August 21st, 2008 at the request of casino critics, who say that the Seneca Buffalo Casino is operating illegally because they are not shutting down their gaming operations despite the decision of the court that offering gaming on the site is illegal.
Judge William Skretny invalidated a decision of the National Indian Gaming Commission allowing gaming on the Buffalo location earlier this month. But Seneca officials said that since the decision of Judge Skretny does not include an order that they should shut down their operations immediately, it is business as usual while the legal battle continues.
In his previous decision, Judge Skretny commented that while the 9 acre panel can be considered as part of the sovereign territory of the Seneca Tribe, it is not eligible for gaming because it was received as part of a land claim.
